1. In consideration of being permitted to participate and perform volunteer services for and/or on behalf of Military Animal Project, a California 501(c)(3) non-profit corporation, I, the undersigned, for myself and my family members, heirs and representatives (collectively, “Volunteer Parties”) voluntarily, knowingly and of my own free will execute this Volunteer Release of Liability (the “Release”) and expressly waive any and all rights, claims and causes of action (collectively, “Claims”) in perpetuity, including, without limitation, any Claim involving any injury (including, without limitation, bodily injury or property damage) suffered by me or bodily injury and/or damage to property suffered by any Volunteer Party while I am engaged, either directly or indirectly, in the performance of volunteer services for and/or on behalf of MILITARY ANIMAL PROJECT (MAP). I understand that nothing in this Release obligates me to perform volunteer services for any specific duration or for any specified length of time.
2. By signing below, I hereby agree to indemnify, defend and hold MILITARY ANIMAL PROJECT, MAP DOG TRAINING & EQUINE FACILITY at 14035 Red Rock Road, Reno, NV 89508, its employees (if any), volunteers, directors, officers and affiliated parties harmless from any and all liability, damage, loss and expense incurred as a result of any Claim brought against MILITARY ANIMAL PROJECT, jointly or individually, for any injury (including, without limitation, bodily injury or property damage) suffered as result of my and/or a Volunteer Party’s negligent, reckless or willful misconduct or as a result of the omission of performance or failure to perform my volunteer services in a reasonable manner.
3. CERTIFIED THERAPY DOG HANDLERS: Dogs must be kept at least TWO FEET from other dogs and animals at all time while representing and attending MILITARY ANIMAL PROJECT Veteran events/Visits/Functions. This removes any potential for accidental injury, bites or negative interactions. Handlers and dogs should be focused on interacting with attendees/public/patients and preventing any interaction with dogs that could possibly lead to an injury to a third party, other handlers or their dogs. Your dog’s safety, welfare and comfort is your first priority.
4. I acknowledge that my appearance in promotions (including, without limitation, print media, online or otherwise) for and/or on behalf of MILITARY ANIMAL PROJECT constitutes part of my volunteer services and that I shall not be entitled to any compensation for such appearances. Furthermore, I hereby authorize MILITARY ANIMAL PROJECT to use my name, likeness, voice and biographical information in connection with any and all promotional purposes and I hereby release MILITARY ANIMAL PROJECT, its employees (if any), volunteers, directors, officers and affiliated parties from any and all claims and demands arising out of or in connection with such use.
5. I will refrain from any offensive or distasteful remarks or conduct in the rendering of volunteer services and will conduct myself in a courteous and professional manner at all times during the rendering of the volunteer services and acknowledge that MILITARY ANIMAL PROJECT shall have sole right and discretion to terminate my status as a MILITARY ANIMAL PROJECT volunteer and discontinue my opportunity to volunteer for and/or on behalf of MILITARY ANIMAL PROJECT.
6. This Release is executed without any reliance upon any representation by any person and I, the undersigned, have carefully read and understand the contents of this Release and execute the same knowingly and of my own free will. I acknowledge and agree that as a MILITARY ANIMAL PROJECT volunteer I am NOT covered by Workers Compensation, (Labor Code section 3352 (l), “Workers Compensation Benefits”) or any other insurance policy for any damages or injuries that I may sustain during my performance of volunteer services for and/or on behalf of MILITARY ANIMAL PROJECT.
7. Nothing in this Release shall be deemed to create any partnership, agency relationship or fiduciary relationship between MILITARY ANIMAL PROJECT and the Volunteer Parties. This Release and the rights and obligations of the parties under this Release shall be governed by and construed in accordance with the internal laws of the state of Nevada and California.
If this Release is signed by a minor (under the age of 18), the following must be completed by a parent or guardian: I warrant that I am a parent (or legal guardian) of the minor whose signature appears immediately above, and I hereby agree that I and the said minor will be bound by all releases, consents and covenants contained in this Release.
1. I give my consent to Military Animal Project and its designated photographers and videographers to take photographs videos of me.
2. I agree that Military Animal Project, formerly known as Pets for Vets Ventura County, can use photographs and videos of me, whether taken before or after this date, for the purpose of promoting and marketing Military Animal Project.
3. I understand that Military Animal Project will not, without my written consent, use any photographs or videos of me for any purpose other than promoting or marketing Military Animal Project.
4. I understand that I am not the owner of any photographs or videos of me taken by Military Animal Project, formerly known as Pets for Vets Ventura County, whether before or after this date. However, I have the right to use the copies of photographs and videos that Military Animal Project may provide to me for my own personal use, so long as the photographs or videos are not used for promoting or marketing any person or entity other than Military Animal Project.
